Online and remote marriage: validity and precautions

The principle: the unified session

The contract requires a wali and two witnesses: "any woman married without her wali's consent, her marriage is void" (Muslim 1414; al-Bukhari 5112), and offer and acceptance before them. Distance does not break this structure: the video or phone call unifies the session when the wali pronounces, the groom accepts from abroad, the witnesses hear both. The ECFR addressed the question in the final statement of its 32nd ordinary session, devoted to marriage through networked visual communication technologies.

The classical condition set by the fuqaha: one real assembly: wali, witnesses and acceptance within a single session, even at a distance; doubt about identity or about hidden words of the wali breaks validity.

The real dangers

• Person substitution: see the wali and the groom on video before the contract, check civil status and identity.
• Scams: fake wali, hidden polygamy, mahr never paid: document the mahr, register the civil act promptly.
• Rush: the supervised meeting and the consent verified by the wali precede or accompany the contract; the civil act follows quickly, the walima when reunited.

Practical note

The safe method: a supervised meeting, consent verified by the wali, a contract by video with witnesses and a serious officiant if distance requires, a prompt civil act, the walima when reunited: distance nikah is an authorized flexibility, not a ghost marriage.
