📖 1 min readعن جابر رضي الله عنهما عن النبي صلى الله عليه وسلم قال: «إذا اسْتَهَلَّ المَوْلُودُ وَرِثَ».
Jābir (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: "A newborn who cries after birth is entitled to inheritance."
This Hadīth shows that a baby who cries, sneezes, shouts, or does anything indicating that he is alive after he is born deserves inheritance. Since he is alive, he has fulfilled the condition for being an heir. The same ruling applies to the baby who cries after birth and then dies: he inherits. He is also to be washed, shrouded, and prayed over.
If killed, the killer must be killed in retribution or pay blood money.
