What is dead land?

Mawat is land without an owner, without water or development, benefiting only if water is brought to it, a spring opened or a well dug. Hanafis: any land yielding no benefit for lack of water or excess of it, rock or marsh, belonging to no one. Malikis: whatever escaped all appropriation. Shafiites and Hanbalis add the measure: what is neither inhabited nor a protected neighbour of an inhabited place. Land falling back to waste after development keeps its owner per the majority (Hanafis in the correct view, Suhnun among Malikis, Shafiites, Hanbalis), while dominant Malikis, one Hanafi voice and one Shafii way return it to dead land after long neglect.

The legal evidence

The Sunna establishes it through several hadiths: « Whoever develops a land belonging to no one, it is his by right » (al-Bukhari 2210, from Aisha, applied by Umar); « Whoever revives a dead land, it is his, and no usurper has any right to it » (Abu Dawud 3073, at-Tirmidhi 1378, an-Nasa'i 5761, from Sa'id ibn Zayd); « Whoever revives a dead land, it is his, and what it feeds in health is a charity for him » (reported by Ahmad, ad-Darimi, at-Tirmidhi). Consensus is reported by Ishaq ibn Rahawayh, al-Juwayni, Ibn Hubayra, Ibn Qudama and Ibn Hazm: dead land is acquired by development, the schools differing only on conditions.

Is the authority required?

Land near habitation: Hanafis and Malikis require the governor's permission, for developing it may harm the inhabitants, narrowing their passages and pastures, and Umar wrote to his guardian-agent: « Fold your wing before the people and fear the oppressed person's invocation » (reported by Malik in the Muwatta). Shafiites, Hanbalis and some Malikis hold to the general hadith without permission, lands attached to the town's interests (roads, water run-off, refuse spots) remaining out of appropriation without disagreement (Ibn Qudama).

The form of development

It varies with the purpose and returns to custom: a dwelling (enclosed and roofed), an orchard (enclosed and planted), a field (ploughing, levelling and access to water), a well (water gushing). Hanbalis require a wall and a water point, per « whoever encloses a land with a wall, it is his » (Abu Dawud 3077). Malikis count seven acts, among them digging water, draining, building, planting, clearing. If developed land then abandoned until effaced is taken by another: dominant Malikis give it to the second; Hanafis, Suhnun, Shafiites and Hanbalis return it to the first known owner.
