Definition Al-imsak

Al-imsak according to Mu'jam al-Mustalahat al-Fiqhiyya

In language: the seizure; one says: amsaktu-hu bi-yadi imsak: I seized it with my hand. Among its meanings also: abstention; one says: amsaktu 'an al-amr: I desisted from the matter. It has been said: it is from mask with mobility (the vowel of the mim), which is an enveloping that holds the thing captive; from it mask with the fatha for the skin. The jurists used imsak in both linguistic meanings in different places: what they intend by imsak in the offenses (jinayat) is the seizure by the hand; so if one man seizes another and a third kills him, the one who seized is killed in retaliation (qisas) according to the Malikis, if the seizure was intended to kill, while according to the others he is not killed, as will come. What they intend by imsak in fasting: abstaining from the things that break it, refraining from eating, drinking and intercourse, as they have expressly stated. It has also been said: it is the holding of the thing, clinging to it, taking it and seizing it. Imsak with respect to speech is silence; and imsak is stinginess; and the saying of the Exalted: (Confine them in their houses).
