Definition Al-kfal-a

Al-kfal-a according to Kitab at-Ta'rifat (Al-Jurjani)

The joining of the guarantor's liability (dhima) to that of the principal debtor in the demand.

Al-kfal-a according to Al-Kulliyat (Al-Kafawi)

It is, in language: joining. Allah, the Most High, said: 'and Zakariyya took charge of her' (Al 'Imran, 37), that is, joined her to himself.

Al-kfal-a according to Dustur al-'Ulama (Al-Ahmadnagari)

In language: joining absolutely. In the Sharia: joining the guarantor's liability to the principal debtor's in the demand, not in the debt; the debt thus remains upon the principal debtor's liability as it was. Malik, may Allah have mercy on him, said: the principal debtor is discharged; and it has been said regarding the debt, which is the Shafi'i's view, may Allah have mercy on him: the debt of one becomes two debts.

Al-kfal-a according to Mu'jam al-Mustalahat al-Fiqhiyya

It is a verbal noun: 'kafala bi-hi kafalan wa kafulan', 'kafaltu-hu' (I guaranteed it), 'kafaltu 'an-hu' (I stood surety for him). In language: joining; hence the word of the Most High: 'and Zakariyya took charge of her.'

Al-kfal-a according to Maqalid al-'Ulum (As-Suyuti)

The obligation to bring before the judge's court the one whose presence is required, with his consent or that of his guardian, or a specified person ('ayn) whose death obliges replacement.

Al-kfal-a according to At-Tawqif (Al-Munawi)

From al-kafal (the skull cap): enclosing a thing from all its sides until one is over it like the revolving sphere; thus mentioned al-Harali. [Chapter of the lam].

Al-kfal-a according to At-Ta'rifat al-Fiqhiyya (Al-Barkati)

It is the joining of the guarantor's liability to that of the principal debtor in the demand. Al-Nasafi said: 'Kafala is a guarantee (daman).'
