Sale at the earlier price, without increase of profit. It is called tawliya because the seller is as if he made the buyer the custodian (wali) of what he bought, for the price at which he bought it; murabaha stands opposed to it.
In language: masdar of walla, tawliya; one says: 'I entrusted such a one with the matter': I invested him with it; and: 'I made him governor of the land and charged with the land, and guardian of the boy and the woman', that is, made him wali over them. The principle of tawliya is investing with office; one says: 'so-and-so held the judgeship and such an office'. Tawliya is also: the buyer's making of what he bought a gift to another at his own purchase price, as Ibn 'Arfa said.
Placing another, in the buyer's stead, in what he bought, by a legal utterance.
From walla a man with a task: when one installs him in it (appointment). Investing with office (installation). Victory.
