It is the opposite of the territory of Islam, that is, that over which the non-Muslims have prevailed; thus it is said in An-Nahr: what is neither a territory of war nor a territory of Islam should be attached to the territory of war, like the salt sea, since no one can prevail over it. In Radd al-Muhtar: the ruling likewise applies to the salt sea and its like, as a desert beyond which there is no land of Islam. In Ad-Durr al-Mukhtar: a territory of Islam becomes a territory of war only by three things: the enforcement of the decrees of the polytheists, its contiguity with a territory of war, and the absence in it of any Muslim or dhimmi protected by the first safe-conduct; and a territory of war becomes a territory of Islam by the enforcement of the decrees of the people of Islam in it.
