With damma: the hairline’s end from the head’s fore or rear. With kasra: exchange, doing to the actor what he did; killing for killing, wounding for wounding, taking what he gave. If the talion inherited to heirs, the major heir takes possession before the minor’s majority, unlike when of adults: the present holds it not in the other’s absence, by consensus, pardon’s eventuality remaining.
Following the trace; said: « he traced his trace » pursuing him; hence His word: « and she said her brother: trail him! ».
The blood-effusing right due the slain’s guardians on the killer, in pure deliberate murder.
With kasra: the talion. As-Sayyid said: « doing to the aggressor-actor what he did ». An-Nasafi said: « killing against killing, and the limb’s destroying against the limb’s destroying ».
﴿يَـٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ كُتِبَ عَلَيْكُمُ ٱلْقِصَاصُ فِى ٱلْقَتْلَى ۖ ٱلْحُرُّ بِٱلْحُرِّ وَٱلْعَبْدُ بِٱلْعَبْدِ وَٱلْأُنثَىٰ بِٱلْأُنثَىٰ ۚ فَمَنْ عُفِىَ لَهُۥ مِنْ أَخِيهِ شَىْءٌۭ فَٱتِّبَاعٌۢ بِٱلْمَعْرُوفِ وَأَدَآءٌ إِلَيْهِ بِإِحْسَـٰنٍۢ ۗ ذَٰلِكَ تَخْفِيفٌۭ مِّن رَّبِّكُمْ وَرَحْمَةٌۭ ۗ فَمَنِ ٱعْتَدَىٰ بَعْدَ ذَٰلِكَ فَلَهُۥ عَذَابٌ أَلِيمٌۭ﴾
« O you who have believed, prescribed for you is legal retribution for those murdered - the free for the free, the slave for the slave, and the female for the female. But whoever overlooks from his brother anything, then there should be a suitable follow-up and payment to him with good conduct. This is an alleviation from your Lord and a mercy. But whoever transgresses after that will have a painful punishment. »
Surah البقرة : 178
﴿وَلَكُمْ فِى ٱلْقِصَاصِ حَيَوٰةٌۭ يَـٰٓأُو۟لِى ٱلْأَلْبَـٰبِ لَعَلَّكُمْ تَتَّقُونَ﴾
« And there is for you in legal retribution [saving of] life, O you [people] of understanding, that you may become righteous. »
Surah البقرة : 179
﴿ٱلشَّهْرُ ٱلْحَرَامُ بِٱلشَّهْرِ ٱلْحَرَامِ وَٱلْحُرُمَـٰتُ قِصَاصٌۭ ۚ فَمَنِ ٱعْتَدَىٰ عَلَيْكُمْ فَٱعْتَدُوا۟ عَلَيْهِ بِمِثْلِ مَا ٱعْتَدَىٰ عَلَيْكُمْ ۚ وَٱتَّقُوا۟ ٱللَّهَ وَٱعْلَمُوٓا۟ أَنَّ ٱللَّهَ مَعَ ٱلْمُتَّقِينَ﴾
« [Fighting in] the sacred month is for [aggression committed in] the sacred month, and for [all] violations is legal retribution. So whoever has assaulted you, then assault him in the same way that he has assaulted you. And fear Allah and know that Allah is with those who fear Him. »
Surah البقرة : 194
﴿وَكَتَبْنَا عَلَيْهِمْ فِيهَآ أَنَّ ٱلنَّفْسَ بِٱلنَّفْسِ وَٱلْعَيْنَ بِٱلْعَيْنِ وَٱلْأَنفَ بِٱلْأَنفِ وَٱلْأُذُنَ بِٱلْأُذُنِ وَٱلسِّنَّ بِٱلسِّنِّ وَٱلْجُرُوحَ قِصَاصٌۭ ۚ فَمَن تَصَدَّقَ بِهِۦ فَهُوَ كَفَّارَةٌۭ لَّهُۥ ۚ وَمَن لَّمْ يَحْكُم بِمَآ أَنزَلَ ٱللَّهُ فَأُو۟لَـٰٓئِكَ هُمُ ٱلظَّـٰلِمُونَ﴾
« And We ordained for them therein a life for a life, an eye for an eye, a nose for a nose, an ear for an ear, a tooth for a tooth, and for wounds is legal retribution. But whoever gives [up his right as] charity, it is an expiation for him. And whoever does not judge by what Allah has revealed - then it is those who are the wrongdoers. »
Surah المائدة : 45
