Definition Radd

Radd according to Kitab at-Ta'rifat (Al-Jurjani)

Lexically: sending back. As a term: returning what remains after the fixed-share holders’ shares; entitled only among the asaba, by their rights’ measure.

Radd according to Dustur al-'Ulama (Al-Ahmadnagari)

In the inheritance-shares’ terminology: giving what remains of the estate after the fixed-share holders’ share to them by the proportion between their shares, absent asaba. Otherwise: returning what remains after the fixed-share holders’ share to them by their rights’ measure, none entitled among asaba; rad applies to relative-share holders, not causal-share holders, the two spouses. Az-Zayla’i mentioned what remains after one spouse’s share returns him our time, as detailed in the asaba from the cause’s side, if Allah wills.
