Emails, screenshots, videos, invoices: how fiqh qualifies digital evidence in today's disputes.

Classical fiqh knew writing (kitaba) alongside testimony; the digital era multiplied its forms. The rule remains: evidence is qualified by its probative function, not by its medium, and writing remains the protection the Quran commands.

The foundation: the Quranic writing

O you who believe, when you contract a debt for a fixed term, write it down... it is more just with Allah, more upright for the testimony and more likely to remove doubt.

sura al-Baqara 282

The verse makes writing the normal method of debt, with the dictation of the debtor fearing Allah his Lord, and this promise: "Fear Allah, and Allah teaches you" (sura al-Baqara 282). Acknowledgment in writing counts as confession: the one who signs a recognition is treated as the one who pronounces it with his mouth (Ibn Qudama, Al-Mughni, chapter of the iqrar).

The admitted modern forms of evidence

  • Electronic writings: the French Civil Code (article 1366, issued from ordinance No. 2016-131 of 10 February 2016) gives the electronic writing the same probative force as paper writing when the person is identified and conservation assured: the legal framework joins the Quranic logic of writing, and the Muslim uses it to document his contracts.
  • Messages (SMS, messengers): admitted as serious indication, to be confronted with other elements, for the possible falsification makes them evidence to corroborate, not absolute evidence.
  • Photos and videos: they establish a visible fact (defect, scene, state of premises); expertise verifies their integrity; they do not replace testimony for non-visible facts (intention, speech).
  • Sound recordings: contemporary scholars discuss their guarantees (context, integrity) and generally admit them as complementary indication; the judge decides according to his law of evidence.

The practical hierarchy of evidence

Confession, testimony, writing, indication: the classical order of fiqh (see the page la-preuve-et-le-serment-decisoire), founded on the hadith: "Proof is upon the claimant, and the oath upon the one who denies" (al-Bayhaqi, As-Sunan al-Kubra). In practice: document every contract in writing (the verse requires it), preserve the evidence (invoices, time-stamped captures), resort to the expert for authentication. The false document is a grave sin and a criminal fraud.

Practical note on modern evidence

Every serious transaction: writing + witnesses + proof of payment (traceable transfer). The Muslim documents his business life as the verse orders it: the best of preventions, and the most modern.
