📖 2 min readA reciprocal form (mufa'ala) of darb, which is traveling through the land. In the Sharia: a partnership contract on profit, with capital provided by one man and labor provided by another. It is at first an initiative (ibda'), an agency (tawkil) when the work is performed, a partnership if profit is made, an usurpation (ghasb) if the manager breaches the terms, a sale (bid'a) if the entire profit is stipulated for the owner of the capital, and a loan (qard) if it is stipulated for the mudarib.
A reciprocal form of darb fi al-ard, which is traveling through the land. Allah, the Exalted, said: (Quran 73:20: "and others who travel through the land"), meaning those who journey for trade. In the Sharia, it is a partnership on profit: capital on one side, belonging to the owner of the funds, and labor on the other side, that of the mudarib (manager).
This contract is called mudaraba because the mudarib most often travels through the land in pursuit of profit.
