Definition Al-mnaskha

Al-mnaskha according to Kitab at-Ta'rifat (Al-Jurjani)

A reciprocal form of naskh, which is transfer and replacement; technically: the transfer of an heir's share, upon his death before division, to whoever inherits from him.

Al-mnaskha according to Dustur al-'Ulama (Al-Ahmadnagari)

A reciprocal form of naskh, in language transfer and conversion. In the usage of the masters of inheritance: the transfer of one heir's share, before division, to whoever inherits from him.

Al-mnaskha according to Mu'jam al-Mustalahat al-Fiqhiyya

In language: masdar of nasakha munasikha, like khasama mukhasama; plural: munasakhat; al-nasikh: agent form of al-naskh. Al-Jawhari said: tanasukh in inheritance: heirs dying after heirs, the root of the inheritance remaining undivided. It is said: from al-naskh, which is transfer, conversion, and replacement. In religious law, in Anis al-Fuqaha: tanasukh in inheritance: heirs dying after heirs, the root of the inheritance remaining undivided; so in the Sihah, and likewise in the Matla'. In the Ta'rifat: the transfer of one heir's share, by his death, before division, to whoever inherits from him. In the Rawd al-Murbi': the death of a second or more heirs of the first before his estate is divided (Anis al-Fuqaha, p. 304; al-Ta'rifat, p. 211; al-Matla', p. 304; al-Rawd al-Murbi', p. 364).

Al-mnaskha according to Maqalid al-'Ulum (As-Suyuti)

That heirs die after heirs, the inheritance remaining thereafter undivided.

Al-mnaskha according to At-Tawqif (Al-Munawi)

A reciprocal form of naskh, which is transfer and replacement.

Al-mnaskha according to At-Ta'rifat al-Fiqhiyya (Al-Barkati)

In the usage of the inheritance specialists: the transfer of one heir's share, before division, upon whoever inherits from him. Al-Nasafi said: 'munasakha is that a man die leaving property and heirs, and before it is divided among them some of them die; his share passes to another, and the two inheritances are divided by the portions of the survivors.'
