It is the sale of merchandise at a prior price with an increase of profit; there is no murabaha in currencies; hence if one buys dinars with dirhams, it is not permissible thereafter to sell the dinars as murabaha, thus in the Fatawa of Qadikhan.
In language: from 'al-ribh' (profit), which is growth and increase; one says 'I profited him upon his merchandise (rabah tuhu 'ala sil'atihi murabaha)': I gave him profit and he gave me property, meaning on condition the profit be shared between us. Some shaykhs are reported to have found the jurists' term 'al-murabaha' problematic, because it is a reciprocal noun (mufa'ala), whereas the one seeking profit is the seller; some answered that this falls under their saying 'I raced the sandal (taraqatu l-na'l)'; and another is reported to have held that murabaha occurred from both sides, seller and buyer each seeking profit; Ibn 'Arfa (may Allah have mercy on him) objected, and it is evident. In technical usage: it is the sale of merchandise at a prior price with an increase of profit, and there is no murabaha in currencies; hence if one buys dinars with dirhams, it is not permissible thereafter to sell the dinars as murabaha, thus in 'Fatawa Qadikhan' and 'Dastur al-'ulama'. Ibn 'Arfa defined it: the sale whose price is set upon the price of a previous sale. Al-Quduri defined it: the transfer of what one owns by the first contract, at the first price, with an increase of profit. Al-Manawi defined it: the sale at an increase over the first price. It is said: the sale of murabaha is the sale of what one owns by what constitutes its basis, with a surplus; it is thus a sale of the item, that is, the merchandise, at the price at which it was bought, with a known increase of profit.
