Definition Al-qraḍ

Al-qraḍ according to Mu'jam al-Mustalahat al-Fiqhiyya

Derived from al-qard, which means cutting. It was named as such because the owner carves out a portion of his wealth for the worker to manage, along with a portion of the profit. It is also called mudarabah, as explicitly stated by an-Nawawi in al-Minhaj, and muqardah. Thus, qirad is: mudarabah on earth. Terminologically: al-Quduri defined it by saying: a partnership contract with wealth from one of the two partners and work from the other. In Sharh Hudud Ibn Arafa: enabling someone to trade with wealth in exchange for a part of its profit, not using the wording of lease. In al-Kafi: for a man to hand over dirhams or dinars to another man to trade with them and seek the provision of Allah from whatever Allah grants of profit in that wealth, so it is between them according to their condition, whether a half, a third, a quarter, or a known part. In Fath ar-Rahim: an agency over known wealth belonging to another, which he trades in for a known undivided share of its profit according to agreement. In Fath al-Muin: to contract over wealth one hands over to another to trade in, on the condition that the profit is shared between them. According to al-Ansari: it is the agency of an owner placing his wealth in the hands of another to trade with it, and the profit is shared between them. In at-Tawqif: the handing over by one legally capable to his like of dirhams or dinars to trade in for a known part of the profit. Ibn Qudamah defined it in al-Umdah by saying: that one of them hands over wealth to the other to trade in, and they share in its profit. Al-qraḍ according to Maqalid al-'Ulum (As-Suyuti)
