Definition Al-sharṭ al-faasid

Al-sharṭ al-faasid according to Dustur al-'Ulama (Al-Ahmadnagari)

In transactions, every condition not required by the contract and containing a benefit for one of the two contracting parties or for the subject matter of the contract, while having the capacity to claim a right against another by being a human being, meaning capable of having a right established for him and being valid for him to litigate and demand the right, even if the subject of the contract is not.

Al-sharṭ al-faasid according to Al-Qamus al-Fiqhi

According to the Hanafis: it is the addition of what the contract does not require and does not suit it. Al-Fasad (corruption): verbal noun. -: the opposite of righteousness. In the Glorious Quran: ﴿That ultimate abode, We appoint it for those who do not desire haughtiness upon the earth nor corruption, and the outcome is for the righteous﴾ (Al-Qasas: 83). -: drought and famine. In the Noble Book: ﴿Corruption has appeared on land and sea because of what the hands of people have earned so that He may let them taste a part of what they have done, that perhaps they might return﴾ (Ar-Rum: 41). -: inflicting harm. - The legal term: the failure to fulfill the conditions. (Al-Dasuqi). - According to the Malikis, Shafiis, and Hanbalis: it is nullity. - According to the Hanafis: it is synonymous with nullity in acts of worship, whereas in transactions, it is a third category distinct from validity and nullity. - In worship according to the Hanafis: it is the departure of the act of worship from being an act of worship due to the omission of certain obligatory elements. The corrupt woman according to the Shafiis: she is the one in whom blood begins that is not menstruation. Al-Mafsadah: harm. (Pl.) Mafasid. -: what leads to corruption from amusement, play, and the like. -: the opposite of interest.
