Definition Al-sawm

Al-sawm according to Kitab at-Ta'rifat (Al-Jurjani)

Asking the merchandise at the price at which sale is concluded.

Al-sawm according to Dustur al-'Ulama (Al-Ahmadnagari)

In the Sharia: asking the sold at the price at which sale is concluded. In al-Maghrib: 'sama al-ba'i' al-sil'a': the seller displayed the goods, that is, showed them and mentioned their price, and the buyer 'samaha' meaning 'istamaha' (asked its price). From it: 'the man does not sisom', that is, does not buy. The Prophet (may Allah's prayer and peace be upon him) said: 'Let not a man bid against his brother's bidding, nor court against his brother's courting.' In al-Miskini, commentary on Kunz al-Daqa'iq: bidding against another's bid is disapproved: it is raising the price after its settlement out of desire to buy, and that when the two contracting parties are content with a price; as for one who bargains while neither has inclined to the other, there is no blame on the other if he bargains and buys.

Al-sawm according to Mu'jam al-Mustalahat al-Fiqhiyya

It is sending cattle upon the land to graze therein; one says: 'samt al-mashiya' (the cattle grazed), and 'asama-ha malikuha' (its owner pastured it); Allah, the Most High, said: 'and trees wherein you pasture (tusimun).'

Al-sawm according to Al-Qamus al-Fiqhi

Of cattle: 'asama-ha': he sent it to graze. : So-and-so: he let him go where he wished. : Of the thing: he came to know it. In the noble hadith: the Messenger of Allah (peace and blessings of Allah be upon him) said on the day of the battle of Badr: 'Mark yourselves (sumu), for the angels have already marked,' that is: make for yourselves a mark by which you may recognize one another. Al-sa'ima: every camel or cattle sent to graze and not fed; (plural) sawa'im; in law: that sufficing with lawful pasture most of the year, for the sake of the beast of burden, the offspring, the increase and the butter (al-Tamartashi). Among the Hanafis: it is the milch beast if it suffices with pasture and that sustains it, or if the more habitual of its state is pasture. Al-samm: death; : one of the sons of Noah (peace be upon him), and he is the father of al-'Ar. Al-sawm: going forth seeking a thing; : asking the sold at the price at which sale is concluded; : pasturing; : mentioning a specific amount for the price. Among the Hanafis: asking the sold at the price of sale. Among the Shafi'is: that one take the goods to examine them: does it please him, so he buys it, or not, so he returns it.
