Al-tḥqyq according to Mu'jam al-Mustalahat al-Fiqhiyya

In language: the masdar of haqqaqa yuhaqqiqu; its root is the firm setting of a thing and its soundness; 'haqaqta al-shay'': you established it and made it binding; 'haqaqtu al-amra wa-ahqaqtuhu': you were certain of it; 'haqaqtu al-khabar fa-ana ahiquhu': I attained its truth. As a technical term: al-Jurjani said, as did al-Munawi: 'Tahqiq is establishing the question by its proof.' It is examination and ijtihad to ascertain the existence of the effective cause ('illa) in individual cases, after that cause has been known from a text, consensus, or deduction; example: justice is the cause of the obligation to admit testimony, its 'illa being established by consensus; so establishing its existence in a particular person by examination and effort is tahqiq al-manat; and no disagreement is known concerning the validity of argument by it when the cause is known from text or consensus.
