Al-tḥqyq according to Mu'jam al-Mustalahat al-Fiqhiyya

In language: the masdar of haqqaqa yuhaqqiqu; its root is the firm setting of a thing and its soundness; 'haqaqta al-shay'': you established it and made it binding; 'haqaqtu al-amra wa-ahqaqtuhu': you were certain of it; 'haqaqtu al-khabar fa-ana ahiquhu': I attained its truth. As a technical term: al-Jurjani said, as did al-Munawi: 'Tahqiq is establishing the question by its proof.' (Asas al-Balagha, (haqq) p. 135; Mu'jam al-Maqayis, (haqq) p. 244; At-Ta'rifat, p. 46; At-Tawqif, p. 164).

It is examination and ijtihad to ascertain the existence of the effective cause ('illa) in individual cases, after that cause has been known from a text, consensus, or deduction; example: justice is the cause of the obligation to admit testimony, its 'illa being established by consensus; so establishing its existence in a particular person by examination and effort is tahqiq al-manat; and no disagreement is known concerning the validity of argument by it when the cause is known from text or consensus.
