Dar al-islam according to Mu'jam al-Mustalahat al-Fiqhiyya

Abu Yusuf said: it is the territory in which the decrees of Islam are manifest even if most of its people are disbelievers. Al-Kasani said: every place in which the decrees of Islam are manifest. And he said: there is no disagreement among our companions that the territory of disbelief becomes a territory of Islam through the manifestation of the decrees of Islam in it. Abd al-Qadir al-Baghdadi said: every territory in which the call of Islam has appeared without a guard, without a protector and without payment of the jizya, in which the authority of the Muslims is enforced alongside the people of the dhimma if there are dhimmis among them, and in which the people of innovation have not overcome the people of the sunna, is a territory of Islam. Al-Rafi'i said: it is not a condition of the territory of Islam that Muslims be in it; it suffices that it be in the hands of the imam and within his Islam. Ibn Muflih said: every territory over which the decrees of the Muslims have prevailed. Ibn Hazm said: the territory is ascribed only to the one who prevails over it, who rules in it and owns it. Ibn Tamim said: the territory of Islam is that to which the Muslims came and upon which the decrees of Islam applied to them. Ibn Yahya al-Murtada the Zaydi said: the territory of Islam is that in which the two testimonies and the prayer are manifest, and in which no practice of disbelief appears, even by interpretation, except through proximity, or through the dhimma and the protection of the Muslims. Dar al-islam according to Al-Qamus al-Fiqhi

According to the Shafi'is: it is every country that the Muslims built, such as Baghdad and Basra, or whose inhabitants embraced Islam, such as Medina and Yemen, or that was conquered by force, such as Khaybar, Egypt and the Sawad of Iraq, or that was conquered by treaty while the land belongs to us, the disbelievers being in it and paying the jizya. According to the Hanbalis: it is every country that the Muslims founded, such as Basra, or conquered, such as the cities of Syria. At-tasallum: mutual settlement. At-taslim: peace; in the Glorified Quran: (Indeed, Allah and His angels bless the Prophet; O you who believe, invoke blessings upon him and greet him with a full greeting of peace) (Al-Ahzab: 56); at-taslim also: the offering of acceptance of the judgment; in the Quran: (But no, by your Lord, they will not believe until they make you judge over what disputed among them, then find within themselves no discomfort about what you have decided, and submit in full submission) (An-Nisa: 65). In prayer: at-taslim is the exit from the prayer by the worshiper's saying: peace be upon you.
