📖 2 min readAccording to the Ibadis: it is the town in which the decrees of polytheism (shirk) have appeared, whose ruler is a polytheist, to whom authority belongs and who judges by the decrees of shirk, even if the Muslim is able there to manifest his prayer, his fasting and the like. And this is the well-known view. Another view: it is not a territory of shirk if the Muslim manifests his religion in it.
Another view: it is not a territory of shirk if there is in it a Muslim who openly practices his religion. Ash-shirka: the mingling of two shares so intertwined that they cannot be distinguished; then the name sharika was extended to the contract itself, even without mingling of shares. A contract between two or more persons to carry out a joint undertaking.
In the Law: a contract between partners in capital and profit (at-Tamartashi). In the Law: a contract entailing the establishment of a right in a thing for two or more persons, in common (al-Bajirmi). In the Law: what arises by choice between two or more persons from the mingling of property so that profit is mingled; it may also arise without intent, as in inheritance (Ibn Hajar).
According to the Malikis: the authorization of each of the two partners to the other to dispose, even after the contract. In the time of jahiliyya: the gathering together for a claim or a disposition. In the Majalla (art.
1045): the sharing of what exceeds one person in a thing, and their entitlement to it; but it is also used, by custom and by convention, in the meaning of the partnership contract, which is the cause of this sharing.
