Iqala according to Mu'jam al-Mustalahat al-Fiqhiyya

Lexically: verbal noun of aqala; sometimes said without alef, rare tongue; its sense: lifting, removal; hence their word: « Allah lifted his stumble »: raising him his fall; hence iqala in sale, lifting the contract. Terminology: lifting the contract, annulling its ruling and effects by the two parties’ mutual consent; its sense too the lifting’s expression. In the Law: lifting the contract removing it by both parties’ consent; this measure consensus among jurists, differing considering it rescission or new contract: rescission toward the two contractors, new sale toward a third. Iqala in sale: for silver, annulling the contract. Al-Farisi said: its sense you returning what taken of him, he returning what taken of you.
