📖 2 min readWhat is understood from speech by way of implication, and it has been said that it is to establish for that about which silence is kept a ruling contrary to what has been established in the explicit utterance. In At-Tahqiq Sharh Al-Usul Al-Husamiyy, know that the majority of usulists who are not companions of Ash-Shafi'i, may Allah Ta'ala have mercy upon him, divided the indication of the term into explicit utterance and implication, and they said that the indication of the explicit utterance is what the term indicates in the place of utterance, and they placed what we have named expression, indication, and requirement from this category. They said that the indication of implication is what the term indicates not in the place of utterance. Then they divided implication into implication of concordance, which is that what is remained silent upon is in agreement with the explicit utterance in the ruling, and they also call it the import of the concordant speech and the tone of the speech, which is what we have named the indication of the text. And into implication of contrariety, which is that what is remained silent upon is contrary to what is explicitly stated in the ruling, and they call it the proof of the speech, which is expressed by us as the specification of the thing by mention.
That whose ruling on what is remained silent about contradicts the ruling of the explicit utterance.
