Definition Rba

Rba according to Al-Qamus al-Fiqhi

Raba the child: to rear and raise him. Raba the thing: to make it grow. Ar-riba: surplus, increase. In the Noble Quran: 'Those who consume usury (riba) will not stand except as one stands who is being beaten by Satan into insanity. That is because they say: trade is but like usury. And Allah has permitted trade and forbidden usury' (Al-Baqarah, 275). In the noble hadith: 'The Messenger of Allah (peace and blessings of Allah be upon him) cursed the consumer of usury, its payer, its scribe and its two witnesses, and said: they are all equal.' In legal terms: the surplus free of counter-value, fixed by a legal measure stipulated against one of the two contracting parties in an exchange (al-Tamartashi). In the Shari'ah: the name for the matching of a counter-value with a specified counter-value whose equivalence by the legal measure is not known at the time of the contract, or in which the two countervalues, or one of them, is deferred (al-Ansari). In the Shari'ah: the increase upon specified commodities (Ibn Qudamah). According to the Malikis and Hanafis: it is also every corrupt (fasid) sale. According to the Ibadis: the word is applied to everything unlawful.
