Definition Sariqa

Sariqa according to Kitab at-Ta'rifat (Al-Jurjani)

It is, in the tongue, taking the thing from another covertly. In the Law, in cutting-right: a responsible one taking covertly the value of ten struck dirhams, kept in a place or keeper, without doubt; the stolen’s value below ten struck, no theft in cutting-right; theft made law that the slave avail it against his seller. By ach-Chafi’i: the thief’s hand cut for a quarter dinar, till the poet al-Ma’arri asked the imam Mouhammad:

Sariqa according to Dustur al-'Ulama (Al-Ahmadnagari)

With fa fatha and ’ayn kasra, of saraqa yasriq, daraba yadrib’s pattern: in the tongue, taking the thing from another covertly, without his leave, while he lived or other. In the Law: a responsible one taking covertly ten struck dirhams’ value, kept in place or keeper, without doubt, till the stolen’s value below ten struck: no theft in cutting-right, lawful theft in restitution and guarantee; covert and concealment must be at start and end if theft by day; by night required at start: piercing the wall covertly by night then taking the owner’s wealth openly by force, cut too.

Taking another’s wealth covertly.

Sariqa according to At-Tawqif (Al-Munawi)

Taking what is not one’s own covertly; made in the Law taking the thing from a specified place and specified measure, a specified way.

Sariqa according to At-Ta'rifat al-Fiqhiyya (Al-Barkati)

It is, in the tongue, taking the thing from another covertly; in the Law, cutting-right: a responsible one taking covertly, of Dar as-Salam, ten struck dirhams’ value, kept in a place or keeper, without doubt, till the stolen’s value below ten struck: no theft in cutting-right; theft established by the Law in unlawfulness’s regard.
