Definition Afrd

Afrd according to Al-Qamus al-Fiqhi

Property: the zakat becomes obligatory upon it because it reaches the threshold of zakat. Such a one: to assign him an obligatory share. For such a one: to establish for him a share. Al-fa ri d: the one who knows the shares. Al-far d: the cut in a trunk and the like. (plural) furud. The recitation. The fixing of time. What Allah made obligatory upon His servants. What man imposes upon himself. The allotted gift. In the usage of the Law: obligation. (Ibn Daqiq al-'Id). In the Law: what is established by certain proof: the Book, the Sunna and the consensus. (al-Jurjani). Among the Malikis: that upon which the validity of worship depends. Among the Hanafis: what is established by a categorical proof with no ambiguity; its denier is declared an unbeliever and its neglecter punished. Among the Shafi'is: what is indispensable, whether its omission be sin or not, whether worship or not. Among the Zahirites: he who neglects it remains disobedient to Allah. Among the jurists it is of two kinds: the far d 'ayn (individual), obligatory upon every legally responsible person and not removed by the act of another; and the far d kifa ya (collective), which falls away from the rest of the responsible when a sufficient number perform it. (al-Ba'li). Among the Hanafis it is of two types: categorical: established by a proof categorical in its establishment and its signification, like the explicit and decisive verses of the Quran and the mass-transmitted sunna whose meaning is categorical; and presumptive: established by a proof categorical in its establishment, presumptive in its signification. When the presumptive proof is strengthened in the mujtahid's view until it becomes near to him to the categorical, what is established by it is called far d 'amali (practical obligation), for it is treated as a far d and its neglect is blameworthy; what makes the neglect of the far d void is only its invalidity, but its denier is not declared an unbeliever: this is called wajib, in view of the presumptive character of its proof. In inheritance, according to the Law: the share fixed by the Law for the heir. (al-Ansari). Al-fur da: the entrance. (plural) furud and farad. The river: the dug channel from which water is drawn. Al-far diyy: the one who knows the shares. Al-fari da: the fixed share. (plural) fara'id. Al-fara'id: (plural) fari da. In terminology: the science by which the heirs are known, what they deserve of inheritance, the impediments, the excluded and the excluder, the blocked and the measure of his blocking, and how it is divided between them; its place is the science of inheritance. (al-Husayn al-San'ani).
