📖 4 min readAccording to the jurists, she is the female slave whom her master has made pregnant as is well-known, or whom a man has made pregnant through marriage and then purchased her afterwards or first, as understood from their saying in the chapter of oaths regarding divorce and manumission: there is no purchase by the one who swore the manumission of his concubine mother of his child and his mother of a child. And there are two issues here: the scenario of the first is clear, and the scenario of the second is that a man says to a female slave whom he made pregnant through marriage: if I buy you, you are free in expiation of my oath, so he buys her, she is freed due to the fulfillment of the condition and it does not suffice him for the expiation because her freedom is due by childbearing. Then, know that the mother of a child through marriage is a female slave who gave birth from her husband then he possessed her, or a female slave whom her husband possessed then she gave birth, so understand and remember.
She is the female slave who gave birth from her master under his ownership. According to the Malikis: she is the female slave who became pregnant by her free master. And: she is the free woman whom a possessor made pregnant. According to the Hanafis, Hanbalis, and Jafaris: she is the female slave who gave birth from her master under his ownership. According to the Zahiris: she is every owned female who became pregnant by her master, then miscarried something known to be a child, or gave birth to it. According to the Zaidis: she is the female slave who conceived from her master with a pregnancy, delivered it formed, and the master acknowledged it. Al-umma: the mother. Plural: oumam. A group of people most of whom share a single origin, brought together by inherited traits, shared interests and aspirations, or brought together by a single matter of religion, place, or time. From this is the noble Arab oumma. And in the noble Quran: ﴿You are the best community produced for mankind. You enjoin what is right and forbid what is wrong and believe in Allah.﴾ (Al-Imran: 110). The man who combines the qualities of goodness. And in the sublime Revelation: ﴿Indeed, Abraham was a nation, obedient to Allah, inclining toward truth﴾ (An-Nahl: 120). The religion and the milla, and in the sublime Book: ﴿And similarly, We did not send before you any warner into a city except that its affluent ones said: Indeed, we found our fathers upon a religion, and we are following in their footsteps.﴾ (Az-Zukhruf: 23). Time. And in the sublime Quran: ﴿And if We delay from them the punishment for a limited time, they will surely say: What detains it? Unquestionably, on the Day it comes to them, it will not be averted from them, and they will be enveloped by what they used to ridicule.﴾ (Hud: 8). Meaning We delayed the punishment from them for a limited term.
