Definition Wakala

Wakala according to Dustur al-'Ulama (Al-Ahmadnagari)

With fatha or kasra of the waw: name of the mandate, which is keeping and trust. Hence al-Wakil among Allah’s names: a fa’il form in the fa’il sense on the first reading, the Guardian; in the passive sense on the second, the One relied upon. In the Law: delegating to another the disposal of a legal matter, that is, making the other stand in one’s place in disposal, from him who holds the power of disposal.

Wakala according to Mu'jam al-Mustalahat al-Fiqhiyya

With the waw fatha or kasra: delegation to another. Lexically: from « he entrusted the matter to him » when one relies on him and shows one’s own impotence, from weakness or ease; hence the hadith: « O Allah, leave us not to ourselves ».

Wakala according to Maqalid al-'Ulum (As-Suyuti)

The delegation of what requires, from the person, direct performance, by the offer of one charged.

Wakala according to At-Tawqif (Al-Munawi)

Lexically: delegation to another and the referring of the matter to him.

Wakala according to At-Ta'rifat al-Fiqhiyya (Al-Barkati)
