Definition Aghtsb

Aghtsb according to Al-Qamus al-Fiqhi

The thing: to take it by force. Al-ighti sab: seizure by force. Al-gha s ib: active participle. Among the Malikis: the wrongdoer who sets a barrier between property and its owner, even if he leaves it in the place where its owner had put it. Among the Zaydis: one who takes the property of another openly, relying upon his strength. Al-gha sb: to take a thing wrongfully, whether wealth or other. In the Quran: [al-Kahf, 79: 'And behind them was a king who seized every ship by force.']. According to the Law: to lay hold of the right of another without right. (al-Ansari). In the Law: to take property of value, protected, without the permission of its owner, without secrecy. (al-Jurjani). According to the Law: to replace a justified hand by an unjustified hand, over property of value, protected, transferable, without the permission of its owner. (al-Tamartashi). In al-Majalla (article 881): it is to take the property of another and hold it without his permission; the taker is called gha s ib, the held property magh sub, and its owner magh sub 'alayhi.
