Definition Al-mustamin

Al-mustamin according to Al-Kulliyat (Al-Kafawi)

From al-istima': seeking aman from the enemy, whether fighter or Muslim. Nabdh al-'ahd: violating it.

Al-mustamin according to At-Ta'rifat al-Fiqhiyya (Al-Barkati)

He is the one who enters another's territory under aman, whether Muslim or fighter.

Al-mustamin according to Al-Qamus al-Fiqhi

The seeker of aman. With the Malikis: the fighter who entered our territory under aman. With the Hanafis: whoever entered another's territory under aman, Muslim or fighter; by territory is meant the realm under the dominion of a ruler, Muslim or disbelieving. With the Hanbalis: whoever entered the territory of Islam with an aman he sought. Al-ama: the bondwoman, contrary to the free woman; plural: ima'; in the Quran: "Do not marry polytheist women until they believe; a believing bondwoman is better than a polytheist woman, even though she please you" (al-Baqara 2:221). The Injil: Allah's Book sent down to 'Isa; in the Quran: "My mercy embraces all things: I shall ordain it for those who are God-fearing, give zakat, and believe in Our signs, those who follow the Messenger, the unlettered Prophet, whom they find written with them in the Torah and the Injil" (al-A'raf 7:156-157).
