📖 2 min readAccording to the Hanafis, Shafiis, and Zaidis: it is the oath that a person swears while intentionally lying, intending to take away the property of another person. In the noble hadith: "Whoever swears a patience oath by which he unjustly takes the property of a Muslim will meet Allah while He is angry with him." The ghamous oath (submersive): the false oath that plunges its author into sin. In the noble hadith: "The major sins are: associating partners with Allah, disobedience to parents, taking a life, and the ghamous oath." According to the saying of Ibn Masoud, an opinion of the Hanbalis, and an opinion of the Ibadis: it is the false oath by which the swearer usurps the property of another. According to the Jafaris, the Shafiis, an opinion of the Hanbalis, and an opinion of the Ibadis: it is a false oath concerning the past, whether regarding an action or an omission. According to an opinion of the Ibadis: it is the false oath absolutely.
That in which one deliberately lies, intending to usurp the property of a Muslim. It was named as such due to the author's persistence in committing it despite the deterrents present in his heart (Al-Ta'rifat p. 281).
