Alhrby according to Al-Qamus al-Fiqhi

Al-harbi (the belligerent), according to the Malikis: one who entered our land in a state of war. Al-muharib (agent noun of haraba): according to the Malikis, one who makes the road feared in order to prevent people from travelling on it and benefiting from passage, even if he does not aim at taking the property of travellers but merely at preventing them from benefiting from passage, whether what is prevented is specific or general; or: one who cuts the road to prevent travel, or to take the property of a Muslim or of anyone else, in a manner that makes rescue (of the victims) impossible. According to the Zahiris: one who behaves like an enemy, terrifies the people of the road and spreads corruption in the land, with or without weapons, by night or by day, in a town or in a wilderness, in the caliph's palace or in the congregational mosque, whether the people have appointed an imam or the caliph himself acts, whether he does so with his soldiers or with others, as roving bands in the desert, or villagers settled in their houses, or the inhabitants of a fortress likewise, or those of a great town or a lesser one: whether one or many, whoever fights the passer-by and makes the road feared by killing, taking property, wounding or violating the modest is a muharib, and the ruling of the muharibun applies to him or to them, few or many. According to some scholars: the dhimmi who breaks the covenant, joins the abode of war and fights the Muslims. According to the Ja'faris: whoever brandishes weapons on land or at sea, by night or by day, to terrify travellers, even if he is not of the country, on the most probable view. According to the Ibadis: one who makes the road feared and openly spreads corruption in the land; or one who lies in wait for people on their way, inside or outside the country, to harm them in their property or their persons. Al-muharabah: hirabah (brigandage). Al-mihrab: the chamber (plural: maharib); in the Noble Quran: 'He came out of his prayer chamber (mihrab) to his people and signalled to them to glorify (Allah) morning and evening' (Maryam, 11); it has been said: the mihrab in the verse is the mosque; the inner part of a house and its noblest spot; the imam's place in the mosque; the palace; in the Noble Revelation: 'They made for him whatever he wished: sanctuaries (maharib)' (Saba', 13). Al-mahrub: one who has been robbed of his property.
