Definition Sharth

Sharth according to Al-Qamus al-Fiqhi

Shartaha upon this: to stipulate it as a condition. Ash-sharat: the sign (plural: ashrat). In the Noble Quran: 'Do they but await that the Hour should come upon them suddenly? Its signs (ashratuha) have already come. But how will they remember when it comes to them?' (Muhammad, 18); the deterioration of wealth (its depreciation). Ash-shart: what is stipulated for observance in a sale or the like (plural: shurut). In terminology: that whose absence entails absence, while its presence entails, from no aspect, either presence or absence; it lies outside the quiddity of the thing (Ibn 'Abidin). Among the usulists: that upon which existence depends, without affecting the ruling or leading to it (Ibn 'Abidin). That whose existence is dependent is called mushart (the conditioned), and that upon which it depends is called shart (condition), like ablution in relation to prayer: ablution is a condition upon which prayer depends, but it is not one of its constituent elements and does not affect it.
