Definition Jinaya

Jinaya according to Kitab at-Ta'rifat (Al-Jurjani)

Every forbidden act involving harm to the person or to other than her.

Jinaya according to Dustur al-'Ulama (Al-Ahmadnagari)

With kasra, from jana yajni: originally, picking the tree’s fruit; the sense shifted to creating evil, then to evil, then to the forbidden act: every prohibited act involving harm to the person or other. It pluralizes to jinayat because forbidden acts are of kinds: touching honour, with kasra, named calumny, insult or backbiting; touching wealth, named spoliation, theft or treachery; touching the person, named killing, burning, crucifixion, strangling or drowning; touching the limb, named cutting, breaking, wound or gouging; but in the faqihs’ usage jnaya means the killing of persons and the cutting of limbs.

Every forbidden act involving harm, usage fixing in the faqihs’ tongues upon wounding, cutting and killing.
